All liability for the equipment is the sole responsibility of the Lessee (Customer).
Payments not received within 30 days of the due date are subject to a finance charge of 1.5% per month (18% annual rate).
The equipment described on the rental contract has been received in good repair and operating condition and is accepted by the undersigned subject to all Terms and Conditions stated herein. Lessee acknowledges full understanding of proper and safe operation of the equipment.
Equipment must be returned with the same fuel level it was provided with. Any shortage will be billed at $10.00 per gallon.
TERMS AND CONDITIONS
1. INDEMNITY / HOLD HARMLESS
Customer shall take all necessary precautions regarding the equipment rented and protect all persons and property from injury or damage. Customer agrees to hold harmless and indemnify Quick Equip Rentals, its owners, and employees from and against any and all liability, claims, judgments, attorney’s fees, and costs of every kind, including injuries or death to persons or damage to property arising out of the use, maintenance, or possession of the equipment.
2. ASSUMPTION OF RISK / RELEASE OF LIABILITY
Customer acknowledges that operating rental equipment involves inherent risks. Customer voluntarily assumes all risks of injury or damage arising out of the use or operation of the equipment and releases Quick Equip Rentals from any and all responsibility or liability related to such use.
3. RECEIPT / INSPECTION OF EQUIPMENT
Customer accepts the equipment in “as-is” condition and acknowledges inspection and receipt of all items listed in this agreement in good working order. Any concerns must be reported immediately upon receipt.
4. RENTAL PERIOD / RATES / PAYMENT TERMS
Rental time begins when equipment leaves Quick Equip Rentals’ yard and ends when the equipment is returned, inspected, and checked in by authorized personnel.
Rental Period Definitions:
Daily Rate: Up to 24 hours of possession and 8 hours of machine run time.
Weekly Rate: Up to 7 consecutive calendar days and 40 hours of machine run time.
4-Week Rate (Monthly): Up to 28 consecutive calendar days and 160 hours of machine run time.
Delivery Time Frame
For same-day deliveries placed before 10:00 AM, Quick Equip Rentals will deliver within a 3–5 hour delivery window. For orders placed after 10:00 AM, delivery will occur anytime before the end of the business day. Customer acknowledges that equipment delivery windows are estimates and not guaranteed appointment times. Deliveries within the stated window shall not be considered late.
Advance Orders: For deliveries scheduled in advance (next day or future date), Quick Equip Rentals will provide an estimated 2–4 hour delivery window on the scheduled day. Customer understands that no exact delivery time is guaranteed, and windows are subject to change due to traffic, prior delays, weather, or operational factors. As long as delivery occurs within the assigned window—or a reasonable adjusted window—delivery shall not be considered late.
Payment is due at rental unless an open credit account is approved. Overdue balances are subject to a 1.5% monthly finance charge (18% annual rate).
5. ORDINARY WEAR AND TEAR
Customer is responsible for all damage beyond ordinary wear and tear. “Ordinary wear” does not include abuse, improper use, neglect, or failure to maintain fluids or filters. Equipment must be returned clean and in good condition.
6. OPERATION AND USE
Equipment shall be used only by qualified personnel for its intended purpose. Customer agrees to comply with all federal, state, and local laws and obtain any necessary permits or licenses. Customer shall not transport or sublease equipment without prior written approval.
7. DAMAGE OR LOSS
Customer is fully responsible for any loss or damage to equipment, including theft, vandalism, fire, or accidents. Customer must notify Quick Equip Rentals immediately of any incident. Repairs performed by Quick Equip Rentals will be billed at standard rates.
8. EQUIPMENT PROTECTION PLAN (Optional)
If purchased, this plan provides limited coverage for accidental physical damage to equipment during normal use. It is not insurance. Customer remains responsible for negligence, misuse, theft, or loss due to gross negligence or failure to follow safety instructions.
9. DEFAULT / LEGAL FEES
Failure to comply with these terms allows Quick Equip Rentals to immediately terminate the agreement and repossess equipment. Customer agrees to pay all collection and legal costs, including reasonable attorney fees.
10. GOVERNING LAW AND VENUE
This agreement shall be governed by and construed in accordance with the laws of the State of California. The proper venue for any dispute arising from this agreement shall be Los Angeles County, California.
11. ACKNOWLEDGMENT
By signing below, Customer acknowledges they have read, understood, and agree to these terms and conditions.
